Terms and conditions  

1. SCOPE

  • These terms and conditions apply to all orders placed through our website www.mvlynn.com and any associated websites provided by us.

2. CONTRACT

  • By placing an order, you submit a binding offer to purchase the selected products. The contract is concluded once we confirm the acceptance of your order by email.

3. PAYMENT

  • All prices are displayed in EUR and are final prices. No VAT is charged in accordance with Section 19 of the German VAT Act (UStG).
  • All listed payment methods are accepted.
  • Orders will only be processed and shipped after full payment has been received. Payment must be completed within 7 days after order confirmation.

4. SHIPPING AND TAX

  • Orders are usually dispatched within 14 days of receipt of full payment, excluding weekends and public holidays.
  • In case of a delay, you will be informed via email.
  • If not selected differently, paper goods (such as art prints, stickers or bookmarks) will be delivered via standard mail without tracking.
  • Please be aware of longer delivery times outside of Germany.
  • Customers are responsible for any customs duties, import taxes, or additional fees that may apply in their country.

5. SHIPPING ISSUES AND DAMAGES

  • In the event of loss or damage during transit, please contact us as soon as possible. We will assist you in resolving the issue with the shipping carrier in accordance with applicable consumer protection laws.
  • Please provide clear photographs of the packaging and the damaged items where applicable.

6. CANCELLATION

  • Orders may be cancelled before dispatch. Once an order has been shipped, cancellation is no longer possible. This does not affect any statutory rights of withdrawal that may apply under applicable consumer protection laws.
  • If you exercise your right of withdrawal after the order has been dispatched, we kindly ask that you accept delivery and return the goods in accordance with our withdrawal policy. This helps ensure that your return can be processed without unnecessary delays or complications.

  • All costs incurred as a result of refusing delivery will be charged to the buyer.

7. RETURN AND REFUND

  • Customers residing in the European Union have a statutory right of withdrawal and may withdraw from this contract within 14 days without giving a reason. To exercise this right, please contact us by email with a clear declaration of your decision to withdraw from the contract: mvlynn.art@gmail.com 
  • For customers outside the European Union, returns are accepted only if we are responsible for damaged, defective or incorrectly delivered products, unless otherwise required by applicable law. In such cases, please contact us within a reasonable time after delivery with photographic evidence so that we can assist you.
  • If you withdraw from the contract, you must return the goods without undue delay and in any event not later than 14 days from the day on which you communicated your withdrawal.
  • The customer bears the direct costs of returning the goods, including return shipping and any customs duties, import taxes, or handling fees incurred in connection with the return.
  • We will reimburse all payments received from you, including the cost of standard delivery (the least expensive offered option). Any additional costs resulting from the customer‘s choice of a more expensive shipping method (such as express delivery) will not be reimbursed.
  • Refunds will be processed within 14 days after we have received the returned goods or proof that the goods have been returned, whichever occurs first. 
  • Customers are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
  • Please ensure that returned items are packaged securely to avoid damage during transit. We recommend using a tracked shipping method for returns, as we cannot be responsible for return shipments that are lost or damaged in transit.

8. REPLACEMENT

  • A correct replacement will be provided if we are responsible for damaged, defective, incorrectly delivered, or wrong items. Please notify us as soon as possible after receiving the order and provide clear photographic evidence of the issue.

9. COPYRIGHT AND OWNERSHIP

  • All artworks, designs, illustrations and product images remain our intellectual property and are protected by copyright law.
  • The goods remain our property until full payment of the purchase price has been received.
  • The customer is not authorized to use the products and designs beyond personal use. This includes, but is not limited to, commercial use, reproduction, distribution, resale, licensing or any other unauthorized exploitation.
  • It is prohibited to copy, reproduce, modify or distribute the designs for resale or any commercial purpose.

10. GOVERNING LAW

  • These terms and conditions are governed by the laws of the Federal Republic of Germany. Mandatory consumer protection laws of the customer‘s country of residence remain unaffected.
